File a Claim Properly to Receive Full Benefits

The key to getting your workers' compensation benefits is prompt reporting of your work injury to your supervisor. If your supervisor or other manager is not available, leave a message on his or her voice mail. Make sure you explain exactly how you injured yourself, as well as when and where the injury took place. If you fail to notify your employer, it can result in the delay or denial of workers' comp benefits.

Once you have lost a day, shift or turn of work, your employer is required to report your injury to the Bureau of Workers' Compensation by filing a first report of injury (FROI). If you are the injured worker, make sure you obtain a copy of the incident report for your files.

After the FROI, it gets more complicated. The process is so detailed, in fact, that the Pennsylvania Department of Labor and Industry has a section on its website that is dedicated to helping people fill out the forms and follow the flow of the claims process.

At Cullen Legal, we have a thorough understanding of workers' compensation and know the potential pitfalls that can cause a claim delay or claim denial.

An experienced workers' compensation lawyer may be critical to a worker obtaining benefits. An error made by an insurance adjuster can translate into thousands of dollars. We leave no stone unturned in our attention to detail, so our clients receive the maximum compensation to which they are due.

A factory assembly line worker had problems with a repetitive hand injury, and filed a workers' compensation claim on her own. When she wasn't able to successfully litigate the case on her own, the judge gave her one last chance and strongly advised that she hire an attorney. I have been able to revive her claim and get everything back on track.
