Understanding Workers' Compensation
The Pennsylvania Workers' Compensation Act of June 2, 1915, was created to cover medical expenses for those injured on the job and those who develop work-related illnesses. Workers' compensation benefits are paid by either private insurance companies, employers or a state-run workers' compensation insurance carrier (the State Workers' Insurance Fund).
The law states that every employer must provide workers' compensation coverage for all full-time, seasonal and part-time employees. The law applies to nonprofit corporations, unincorporated businesses, incorporated businesses and businesses that have only one employee.
If you are injured on the job or develop a work-related illness, the Workers' Compensation Act provides for:
- Medical coverage
- Compensation for lost wages until work can resume
- Death benefits for work-related deaths, which are paid to dependent survivors
Your employer may choose to either accept or deny a claim. If your claim is denied, you have the right to file a claim petition with the Bureau of Workers' Compensation and receive a hearing before a workers' compensation judge.
